General Terms and Conditions of Travel (ARB) of ARABIA FELIX Synform GmbH, as at 05.03.2025


The following General Terms and Conditions of Travel (GTCT), insofar as they have been effectively agreed, form part of the package travel contract concluded between the customer (= traveller) and the tour operator ARABIA FELIX Synform GmbH (hereinafter referred to as ARABIA FELIX Synform). The ARB supplement the statutory provisions of §§ 651a ff. BGB and Articles 250 and 252 of the EGBGB and fulfil them.
When booking a package holiday, the contractual partner of the tour operator is the traveller. It is irrelevant whether the traveller makes use of the package tour himself or concludes the contract on behalf of another traveller. These GTC expressly do not apply if the traveller does not book a package tour within the meaning of Section 651a et seq. of the German Civil Code, but only individual travel services (e.g. hotel only, hire car) from ARABIA FELIX Synform. This also applies if the traveller is issued with a security certificate for the individual travel service to secure the travel price paid or if ARABIA FELIX Synform expressly acts as a travel agent for an individual travel service or a combined travel service in accordance with Section 651w BGB and informs the traveller of this separately and unambiguously before booking. Furthermore, these GTC shall not apply to contracts for travel insofar as the traveller is an entrepreneur with whom ARABIA FELIX Synform has concluded a framework agreement for the organisation of business trips in accordance with Section 651a (5) (3) of the German Civil Code for the entrepreneurial purposes of the traveller.


1. conclusion of the package travel contract
1.1 The basis of this offer is the travel advertisement of ARABIA FELIX Synform in the catalogue or brochure valid at the time of travel, on its website, in an individual offer or other medium of ARABIA FELIX Synform, together with supplementary information from ARABIA FELIX Synform for the respective trip, insofar as this is available to the traveller at the time of booking. By registering for the trip (booking), the traveller makes a binding offer to ARABIA FELIX Synform to conclude the package travel contract for the persons specified. The traveller shall be responsible for all contractual obligations of fellow travellers for whom he/she makes the booking as for his/her own, insofar as he/she has assumed this obligation by express and separate declaration. 1.2 The contract is concluded upon receipt of the travel confirmation (declaration of acceptance) from ARABIA FELIX Synform. Upon or immediately after conclusion of the contract, ARABIA FELIX Synform will send the traveller a travel confirmation on a durable medium. If the contract is concluded when the traveller is physically present, the traveller is entitled to a travel confirmation in paper form; the same applies if the contract is concluded outside of business premises. 1.3 If the content of the travel confirmation differs from the travel registration, this travel confirmation is considered a new offer to which ARABIA FELIX Synform is bound for a period of ten days. The contract is concluded on the basis of this new offer, provided that ARABIA FELIX Synform has pointed out the change and has fulfilled its pre-contractual information obligations in this regard and the traveller declares acceptance to ARABIA FELIX Synform expressly or conclusively within the binding period by (down) payment of the travel price. 1.4 ARABIA FELIX Synform points out that bookings of package holidays in distance selling (e.g. by telephone, by e-mail) cannot be cancelled in accordance with §§ 312 para. 7, 312g para. 2 sentence 1 no. 9 BGB. However, a right of cancellation exists if the contract for the package tour was concluded between ARABIA FELIX Synform and the traveller, who is a consumer, outside of business premises, unless the oral negotiations on which the conclusion of the contract is based were conducted at the prior request of the consumer.


2. payment
2.1
After conclusion of the contract, a deposit of 15% of the tour price is due, provided that the security certificate has been sent to the traveller in text form in accordance with Article 252 EGBG. If the flights or accommodation services included in the respective offer are due for payment immediately by the service providers of ARABIA FELIX Synform or if a flight ticket must be issued immediately after the booking has been confirmed, ARABIA FELIX Synform reserves the right to charge a higher deposit. The traveller will be informed of this by ARABIA FELIX Synform prior to the conclusion of the booking in a manner prescribed by Art. 250 of the EGBGB and in the travel confirmation in a manner prescribed by Art. 250 of the EGBGB. The remaining amount is due for payment three weeks before the start of the trip, provided that the trip can no longer be cancelled for the reasons stated in Section 7.1 and the security certificate has been sent in text form. If a trip can still be cancelled for the reasons stated in section 7.1, the remaining amount for this trip is only due at the time when the trip can no longer be cancelled by ARABIA FELIX Synform. 2.2 In the case of bookings made at short notice, i.e. bookings made so shortly before the start of the trip that the entire travel price is already due or ARABIA FELIX Synform can no longer cancel the trip due to the number of participants not being reached, the entire travel price is due for payment immediately after the security certificate has been sent in text form. 2.3 Premiums for insurance and other expenses such as cancellation and rebooking fees are due for payment in full after invoicing. 2.4 If the traveller does not make the deposit or final payment by the respective due date despite having received a security certificate, ARABIA FELIX Synform is entitled to withdraw from the contract after issuing a reminder and setting a deadline and to charge the traveller the cancellation costs regulated in section 4.1 ff.

3. services and changes to services
3.1
ARABIA FELIX Synform's obligation to perform arises exclusively from the content of the booking confirmation in conjunction with the catalogue or brochure valid at the time of travel, the ARABIA FELIX Synform website and the ARABIA FELIX Synform website. brochure, the website of ARABIA FELIX Synform, an individual offer or any other medium of ARABIA FELIX Synform, including all information, notices and explanations contained therein as well as the pre-contractual information relevant to the booked package holiday in accordance with Art. 250 & sect; 3 EGBG. 3.2 Employees of service providers (e.g. airlines, hotels) and travel agents are not authorised by ARABIA FELIX Synform to give assurances or information or to make agreements that go beyond the travel advertisement, the booking confirmation or the pre-contractual information in accordance with Art. 250 & sect; 3 EGBG of ARABIA FELIX Synform, contradict them or change the confirmed content of the package travel contract. 3.3 Changes or deviations of individual travel services from the agreed content of the package travel contract that become necessary after conclusion of the contract and that were not brought about by ARABIA FELIX Synform in bad faith are only permitted insofar as the changes or deviations are not significant and do not affect the overall nature of the booked package tour. Furthermore, these changes must be declared before the start of the holiday. ARABIA FELIX Synform must inform the traveller of the change clearly, comprehensibly and in a prominent manner on a durable medium. 3.4 In the event of a significant change to an essential characteristic of a travel service in accordance with Article 250(3)(1) of the Introductory Act to the German Civil Code or a deviation from a special requirement of the traveller which became part of the package travel contract, the traveller is entitled, within a reasonable period of time set by ARABIA FELIX Synform, to a) to accept the notified change to the travel service or deviation from the special requirements,
c) to declare participation in a substitute package tour offered by ARABIA FELIX Synform, if applicable. If the traveller does not respond to ARABIA FELIX Synform or does not respond within the set, reasonable period, the change or deviation is deemed to have been accepted. ARABIA FELIX Synform will inform the traveller of this, as well as of the significant change or deviation from a special requirement, immediately after becoming aware of the reason for the change, together with the notification of the traveller's rights and a deadline for explanation, in a clear, comprehensible and prominent manner on a durable medium. 3.5 Any warranty claims shall remain unaffected if the amended services are defective. If the replacement package holiday or modified package holiday is not of at least the same quality as the original package holiday, the travel price is to be reduced in accordance with § 651m para. 1 BGB; if ARABIA FELIX Synform incurs lower costs with equivalent quality, the traveller is to be reimbursed the difference in accordance with § 651m para. 2 BGB.


4. cancellation by the traveller before the start of the trip, transfer of contract (replacement person)
4.1
The traveller may withdraw from the package travel contract at any time before the start of the trip. The cancellation must be declared to ARABIA FELIX Synform using the contact details provided at the end of the GTC. If the trip was booked through a travel agent, the cancellation can also be declared to the travel agent. The traveller is advised to declare the withdrawal on a durable medium.
4.2 If the traveller withdraws before the start of the trip or does not start the trip, ARABIA FELIX Synform loses the right to the travel price. Instead, ARABIA FELIX Synform may demand reasonable compensation from the traveller. This does not apply if ARABIA FELIX Synform is responsible for the cancellation or if unavoidable, extraordinary circumstances occur at the destination or in its immediate vicinity which significantly impair the performance of the package tour or the transport of persons to the destination;Circumstances are unavoidable and extraordinary if they are beyond the control of the party invoking them and their consequences could not have been avoided even if all reasonable precautions had been taken.
4.3 ARABIA FELIX Synform has set out the compensation to which it is entitled in the following cancellation fees. The calculation is made taking into account the time of the cancellation declared by the traveller up to the contractually agreed start of the trip, the expected savings in expenses and the expected acquisition through other use of the travel services. The compensation is calculated according to the time of receipt of the cancellation notice by ARABIA FELIX Synform or the travel agent as follows:

a) general cancellation fee:
- from up to 91 days before the start of the trip  15 %
- from 90 to 61 days before the start of the trip  20 %
- from 60 to 45 days before the start of the trip  30 %
- from 44 to 22 days before the start of the trip  40 %
- from 2 to 5 days before the start of the trip  60 %
- from 14 to 7 days before the start of the trip  70 %
- from 6 days before departure  75 %
- on the day of departure and non-commencement of the trip  80%

 

b) special cancellation fee:
Special offers/specials, individually prepared package tours and group tours may be subject to special cancellation conditions, which are expressly referred to in the respective service description or travel advertisement/offer and the travel confirmation in accordance with Art. 250 & sect; & sect; 3, 6 EGBG.

4.4 In any case, the traveller is at liberty to prove to ARABIA FELIX Synform that ARABIA FELIX Synform can only demand a significantly lower reasonable compensation as a result of the cancellation. 4.5 ARABIA FELIX Synform reserves the right to demand a higher, specifically calculated compensation instead of the above cancellation fees if ARABIA FELIX Synform can prove that significantly higher expenses have been incurred than the applicable cancellation fee. In this case, ARABIA FELIX Synform is obliged to quantify the compensation claimed, taking into account the expenses saved and less what it acquires through other use of the travel services, and to justify this at the request of the traveller. 4.6 ARABIA FELIX Synform expressly recommends that travellers take out travel insurance. This is not part of the package travel contract and cannot generally be reimbursed in the event of cancellation of the travel contract; the same applies to the portion of travel insurance included in an insurance package. 4.7 If ARABIA FELIX Synform is obliged to reimburse the travel price as a result of a cancellation, the reimbursement must be made immediately, but in any case within 14 days of the cancellation. 4.8 The legal right of the traveller to declare a transfer of the contract to another traveller on a durable medium in accordance with Section 651e of the German Civil Code (provision of a substitute participant) remains unaffected by the above provisions, provided that ARABIA FELIX Synform receives this notification no later than seven days before the start of the trip. Otherwise, the substitute participant and the traveller are jointly and severally liable to ARABIA FELIX Synform for the travel price and the reasonable and actual additional costs incurred as a result of the substitute participant joining the tour.


5. Rebooking by the traveller before the start of the trip
5.1
The traveller has no legal right to change the date of travel, the destination, the place of departure, the accommodation or the type of transport (rebooking). Of course, this does not apply if a rebooking is necessary due to incomplete or incorrect pre-contractual information in accordance with Art. 250 & sect; 3 EGBG; such a rebooking will be carried out free of charge for the traveller. 5.2 If ARABIA FELIX Synform makes a rebooking at the request of the traveller in accordance with section 5.1 sentence 1, the traveller will be charged for the expenses incurred by ARABIA FELIX Synform as a result of the rebooking, including in particular rebooking and cancellation costs (for non-refundable fares) for booked flights or accommodation and other destination services. The traveller will be clearly and unambiguously informed of these demonstrable expenses incurred prior to a rebooking, as well as any change in the travel price due to the rebooking on the basis of daily updated prices for the new bookings or deviating seasonal times for the services offered by ARABIA FELIX Synform.


6. services not utilised
If the traveller does not make use of individual travel services that ARABIA FELIX Synform has duly offered for reasons for which the traveller is responsible, the traveller is not entitled to a pro rata refund of the travel price. ARABIA FELIX Synform will endeavour to obtain reimbursement of the expenses saved from the service providers. This obligation shall not apply in the case of insignificant services or if statutory or regulatory provisions prevent reimbursement. ARABIA FELIX Synform recommends taking out travel cancellation insurance.

 

7. Cancellation due to failure to reach the minimum number of participants and cancellation by ARABIA FELIX Synform
7.1
ARABIA FELIX Synform may only withdraw from the package travel contract due to a minimum number of participants not being reached if ARABIA FELIX Synform
a) specifies the minimum number of participants in the pre-contractual information regarding the booked package tour and the date by which the traveller must have received the declaration at the latest before the contractually agreed start of the tour, and
b) states the minimum number of participants and the latest cancellation period in the travel confirmation. The traveller must be informed of the cancellation at the latest on the day specified in the pre-contractual information and the travel confirmation. If it becomes apparent at an earlier date that the minimum number of participants cannot be reached, ARABIA FELIX Synform must exercise its right of cancellation without delay. If the trip is not carried out for this reason, ARABIA FELIX Synform must refund any payments made by the traveller without delay, but in any case within 14 days of the declared cancellation. 7.2 ARABIA FELIX Synform may terminate the package travel contract without notice if the traveller persistently disrupts the performance of the trip despite a warning from ARABIA FELIX Synform or behaves in such a way as to breach the contract; behaves in breach of contract to such an extent that the immediate cancellation of the contract is justified; this does not apply if the breach of contract is due to a breach of pre-contractual information obligations. If ARABIA FELIX Synform cancels, ARABIA FELIX Synform retains the right to the travel price, but must allow the value of the saved expenses and the benefits that ARABIA FELIX Synform obtains from any other use of the unused services, including the amounts credited to it by its service providers, to be taken into account.


8. Obligations of the traveller to cooperate
8.1 Travel documents
The traveller must inform ARABIA FELIX Synform or their travel agent with whom they have booked the package tour if they do not receive the required travel documents (e.g. e-ticket receipts, hotel vouchers) within the period communicated by ARABIA FELIX Synform despite timely and complete payment of the travel price. 8.2 Notification of defects
ARABIA FELIX Synform is obliged to provide the package holiday to the traveller free of travel defects. If this is not the case, the traveller is obliged to notify ARABIA FELIX Synform immediately of any travel defects. For this purpose, the traveller must immediately notify the representative of ARABIA FELIX Synform on site. If a representative of ARABIA FELIX Synform is not available on site and is not contractually obliged, the traveller must report the defects directly to ARABIA FELIX Synform. The contact details of a local representative of ARABIA FELIX Synform and their availability as well as the contact details of ARABIA FELIX Synform for reporting travel defects can be found in the travel confirmation. The traveller also has the option of submitting their complaint to the travel agent with whom they booked the package holiday. The representative of ARABIA FELIX Synform is authorised to take remedial action where possible. However, he is not authorised to recognise claims. If ARABIA FELIX Synform is unable to remedy the situation as a result of a culpable failure to report the defect, the traveller may neither claim a reduction in price in accordance with Section 651m BGB nor claim damages in accordance with Section 651n BGB. 8.3 Setting a deadline before cancellation
If a traveller wishes to terminate the package travel contract due to a significant travel defect of the type specified in Section 651i of the German Civil Code, the traveller must first set ARABIA FELIX Synform a reasonable deadline for remedial action. This only does not apply if ARABIA FELIX Synform refuses to provide a remedy or if an immediate remedy is necessary. 8.4 Luggage delay and damage:
a) In accordance with aviation regulations, travellers must report damage to their baggage or loss of baggage or baggage delay immediately on site to the responsible airline by means of a damage report (P.I.R.) and have a confirmation issued in text form for reasons of proof. As a rule, both airlines and ARABIA FELIX Synform will refuse any reimbursement in this respect on the basis of international agreements if the claim notification has not been completed. The damage report must be submitted within 7 days of cancellation in the case of baggage damage and within 21 days of cancellation in the case of baggage delay. b) In addition, ARABIA FELIX Synform must be notified immediately of the damage, loss or delay in luggage in accordance with the details in section 8.2. Notification to ARABIA FELIX Synform does not release the traveller from the obligation to notify the responsible airline of the claim within the deadline in accordance with point (a).


9. Limitation of liability
9.1 The contractual liability of ARABIA FELIX Synform for damages that do not result from injury to life, limb or health is limited to three times the travel price, insofar as these were not culpably caused. If international agreements or statutory provisions based on such agreements apply to a travel service, according to which a claim for damages against the service provider only arises or can only be asserted under certain conditions or restrictions or is excluded under certain conditions, ARABIA FELIX Synform can also invoke this against the traveller. 9.2 ARABIA FELIX Synform is not liable for service disruptions, personal injury and property damage in connection with services that are merely arranged as third-party services, such as excursions, sporting events, musical performances, exhibitions, if these services are expressly labelled as third-party services in the travel advertisement and the booking confirmation, stating the identity and address of the brokered contractual partner, in such a way that the traveller can recognise that they are not part of the ARABIA FELIX Synform package tour. However, ARABIA FELIX Synform is liable for these services if and to the extent that ARABIA FELIX Synform's breach of information, clarification or organisational obligations was the cause of damage to the traveller. 9.3 ARABIA FELIX Synform is not liable for services that are used by the traveller as part of the package tour and are not arranged or organised by ARABIA FELIX Synform or its local representative, but for example by the hotel or other persons or companies on their own responsibility.

 

10 Assertion of claims, consumer dispute resolution
10.1 The traveller must assert claims against ARABIA FELIX Synform in accordance with Section 651i (3) No. 2, 4-7 BGB. The traveller can also assert the claim via the travel agent with whom they booked the package holiday. It is recommended that the claims be asserted on a durable medium.
10.2 ARABIA FELIX Synform points out in accordance with § 36 VSBG (Consumer Dispute Resolution Act) that ARABIA FELIX Synform does not participate in dispute resolution proceedings before a consumer arbitration board and is not legally obliged to do so. Should a legal obligation to participate in such dispute resolution proceedings arise after printing or should ARABIA FELIX Synform participate voluntarily, ARABIA FELIX Synform will inform travellers of this on a permanent data carrier.


11 Passport, visa and health regulations
11.1 ARABIA FELIX Synform shall inform travellers about general passport and visa requirements of the country of destination, including the approximate deadlines for obtaining any necessary visas, as well as health formalities prior to conclusion of the contract and any changes thereto prior to departure. 11.2 The traveller is responsible for obtaining and carrying the travel documents required by the authorities, any necessary vaccinations and compliance with customs and foreign exchange regulations. Any disadvantages arising from non-compliance with these regulations, e.g. the payment of cancellation fees, shall be borne by the customer. This shall not apply if ARABIA FELIX Synform has not provided information or has provided insufficient or incorrect information. 11.3 ARABIA FELIX Synform is not liable for the timely issuance and receipt of necessary visas by the respective diplomatic representation if the traveller has commissioned ARABIA FELIX Synform with the procurement, unless ARABIA FELIX Synform has culpably violated its own obligations.


12th Information on the identity of exporting air carriers
The EU regulation on informing passengers of the identity of the operating air carrier obliges ARABIA FELIX Synform to inform the traveller of the identity of the operating air carrier of all air transport services to be provided as part of the booked trip at the time of booking. If the operating airline has not yet been determined at the time of booking, ARABIA FELIX Synform is obliged to inform the traveller of the airline or airlines that will probably operate the flight or flights. As soon as ARABIA FELIX Synform knows which airline will operate the flight, ARABIA FELIX Synform must inform the traveller. If the airline named to the traveller as the operating airline changes, ARABIA FELIX Synform must inform the traveller of the change. ARABIA FELIX Synform must immediately take all reasonable steps to ensure that the traveller is informed of the change as soon as possible. 13 Applicable law, place of jurisdiction
13.1 The contractual relationship between the traveller and ARABIA FELIX Synform shall be governed by German law.
13.2 The place of residence of the traveller is decisive for legal action by ARABIA FELIX Synform against the traveller. For legal actions against travellers who are merchants, legal entities under public or private law, the place of jurisdiction shall be the registered office of ARABIA FELIX Synform. The same applies to travellers who move their domicile or usual place of residence abroad after conclusion of the contract or whose domicile or usual place of residence is not known at the time the action is brought.

Data protection notice:
The personal data provided by travellers when booking the package tour will be processed electronically and used by ARABIA FELIX Synform GmbH and its service providers (transport companies, hotels, incoming agencies, database providers of entry and health regulations) and processed and stored in the AMADEUS/SABRE reservation system (GDS) used worldwide, insofar as they are necessary for the performance of the contract. Due to a US federal law on the search for terrorists, airlines are obliged to disclose the flight and reservation details of each passenger to the US Transportation Security Administration (TSA) prior to entry into the USA. Without this information, entry into the USA is not possible; this also applies to stopovers and connecting flights. This data must also be transmitted for flights to other countries that only touch US airspace.

Distance selling contracts:
ARABIA FELIX Synform GmbH points out that bookings of package holidays in distance selling (e.g. by telephone, e-mail) cannot be cancelled in accordance with § 312 (7), § 312g (2) sentence 1 no. 9 of the German Civil Code (BGB). However, a right of cancellation exists if the contract for the package tour was concluded between ARABIA FELIX Synform GmbH and the traveller, who is a consumer, outside of business premises, unless the oral negotiations on which the conclusion of the contract is based were conducted at the prior request of the consumer.


Travel insurance:
ARABIA FELIX Synform GmbH generally recommends taking out travel insurance and foreign travel health insurance, including cover for travel costs in the event of accident or illness.
